Dialshade / Terms of Use

Terms of Use

Last updated:

These supplementary terms apply to Dialshade alongside Apple’s Standard EULA and mandatory consumer law. Dialshade is not yet publicly available on the App Store. Paid offers require Apple’s approval and actual availability in the store.

1. Scope and provider

These terms govern the Dialshade iPhone app and Dialshade Pro, offered by Valentin Spöth, sole proprietor, Turnhallestrasse 31, 77654 Offenburg, Germany. They supplement Apple’s Standard Licensed Application End User License Agreement (Standard EULA). If these terms conflict with mandatory law or the Standard EULA in an area controlled by Apple, the mandatory rule or Standard EULA prevails.

2. Use and minors

Dialshade lets you select and customize clock designs and use them as small or medium widgets on the iPhone Home Screen. Use is intended for personal, lawful purposes and must not impair the app, Apple services or the rights of others.

Minors may use Dialshade only as permitted by applicable law and their Apple Account settings. Purchases may require consent from a parent or guardian. Apple’s purchase approval, family and Screen Time features may apply depending on account and country. These terms set no unverified minimum age or App Store age rating; after release, the current App Store listing determines the regional store rating.

3. Functionality and system limits

Five designs are available for free. Optional Pro access unlocks the additional designs and associated customization. Saved looks can be assigned to different widgets. The app describes the current offering and available features.

The app requires iOS 18 or later and a supported iPhone. Widget appearance and updates depend on iOS, WidgetKit, device settings and power-saving states where applicable. Digital widget time is system-managed; analog widget hands use minute-based timelines. Continuous Home Screen animation, second-by-second updates in every system state and unrestricted transparency are not promised.

4. Availability, development and local data

We aim for reliable operation but do not promise uninterrupted or error-free availability. Purchases and restoration may depend on the Apple Account, App Store, internet connection and regional availability. We may maintain and adapt the app for security, compatibility, legal compliance and development, respecting legitimate user interests and mandatory rights to conformity, necessary updates and remedies. This provision does not permit arbitrary withdrawal of paid services.

Favorites, settings and saved looks reside locally in shared app and widget storage. There is no Dialshade account or proprietary cloud synchronization. Device loss, deletion or storage failure can affect data availability. Maintain device security and suitable backups; there is no absolute guarantee against data loss. Apple purchase rights and restoration do not replace a backup of your looks. See the Privacy Policy.

5. Dialshade Pro and in-app purchases

The planned Pro offering includes monthly and annual subscriptions and a non-consumable one-time purchase. All three options unlock Pro. The one-time purchase includes permanent full access to premium features and current and future collections, without a recurring payment for that purchase. “Permanent” describes the acquired usage right and does not promise unlimited operation of every device or Apple service. Statutory claims remain unaffected.

Apple processes purchases and billing. The app verifies StoreKit transactions; RevenueCat receives pseudonymous purchase and SDK data for technical purchase operations and operational reporting as described in the Privacy Policy. Apple displays the applicable regional price, period, renewal terms and any actually available offer before confirmation. No fixed website price forms part of these terms. If purchase products are unavailable, free designs remain usable.

Saved looks and favorites are not automatically deleted when a subscription expires; using Pro designs continues to require valid Pro access. Statutory withdrawal, warranty, refund and other consumer rights remain unaffected. For purchase or refund requests, you can use Apple’s procedures, such as reportaproblem.apple.com; this does not restrict statutory claims against the responsible party.

6. Liability and mandatory rights

Nothing in these terms excludes or limits liability where prohibited by law. We remain liable without limitation for intent and gross negligence, injury to life, body or health, guarantees expressly assumed, fraudulent concealment and mandatory product-liability law.

For ordinary negligence, we are liable only for breach of an essential contractual obligation whose fulfillment enables proper performance and on whose observance users may ordinarily rely; liability is then limited to foreseeable damage typical for the contract. Mandatory consumer warranty, conformity, digital-content and other consumer rights remain unaffected.

7. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent this choice does not deprive consumers of mandatory protections of the country of their habitual residence. Statutory rules on jurisdiction remain unaffected.

8. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

9. Changes and contact

We may update these terms for legal, security, technical or product reasons. Changes will not apply retroactively in a way that unlawfully disadvantages users. Material changes are communicated appropriately. This clause does not replace consent required by law or contract.
